Woman files $6M medical malpractice brain damage suit

When New Yorkers have serious health problems requiring surgery, they rely on doctors and surgeons to provide the best treatment possible. A woman in another state recently filed a medical malpractice against a hospital, alleging that its staff failed to provide adequate care. The lawsuit claims that, following a surgery performed there, the plaintiff suffered brain damage.

The 74-year-old seeks $6 million in damages. In May 2015, a doctor diagnosed her with a tumor in the lining of her brain. The tumor was identified as a non-cancerous type that typically grows slowly and is often simply monitored, as opposed to requiring surgical removal. However, the woman’s doctor apparently advised that she undergo surgery in June 2015, at which time the doctor removed the tumor and part of the woman’s skull, which was repaired with screws and titanium mesh.

According to the lawsuit, the woman developed an infection and began experiencing drainage from the incision. The Infectious Disease Department at the hospital stated that the doctor should have worked to clear the infection by replacing the titanium mesh in the woman’s skull with a new one. Because he failed to do so, the woman will now require an extended course of antibiotics intravenously, the department says.

Approximately six months later, the woman again contacted the hospital, complaining of daily headaches and pain. When the hospital admitted her three days later, attempts were made to remove the screws and titanium mesh. At this point, it was discovered that the mesh had become stuck to a part of her brain membrane and, when removed, resulted in severe blood loss and a subsequent stroke.

The plaintiff now suffers from headaches, vision and memory loss, and an inability to talk or follow commands. Additionally, she struggles with most cognitive functions and had to be admitted to a nursing facility for treatment and therapy.
