New York man arraigned regarding fatal accident charges

On Behalf of | Jan 16, 2017 | Wrongful Death

A New York man was indicted for vehicular manslaughter (felony) and possession of a controlled substance (misdemeanor). This comes after his arrest for involvement in a fatal accident in 2015 that left a woman dead. The defendant has since been remanded to the county jail in Ulster. If convicted, he could face a substantial prison term.

The Ulster County District Attorney’s Office and the New York State Police Bureau of Criminal Investigation investigated the Aug. 25, 2015 accident. Their findings indicate that the accused was driving a minivan westbound on State Route 28 when the vehicle traveled into the eastbound lane. It then collided head-on with a Subaru.

The defendant suffered injuries described as non-life threatening and was treated at a hospital. The driver of the Subaru, however, did not survive the injuries she suffered in the accident. She passed away while being transported to the same hospital. Law enforcement asserts that the defendant was driving while under the influence of a controlled substance, an opiate known as Fentanyl.

The heroin, the large number of used hypodermic needles and crack pipes for smoking cocaine were apparently discovered in the defendant’s vehicle. The family of the deceased woman has every right to contact a New York personal injury attorney in order to consider their options for seeking legal recourse as a result of the fatal accident. A lawyer with experience in wrongful death cases would be able to offer counsel as how best to proceed in filing a civil lawsuit against all parties believed responsible for the death of their loved one.
