A walk down the sidewalk around 3 a.m. on a Saturday led to devastating results for a group of college students. The fatal accident unfolded as the pedestrians were walking on the sidewalk and were struck by a vehicle driven by an alleged drunk driver. The New York crash led to one death, injuries for three and an arrest on several charges for the man behind the wheel.

The car was driven by an off-duty policeman who was just hours from reporting for a shift. The off-duty officer plowed into the group and tried to put the vehicle into reverse. Witnesses at the scene entrapped the man in his vehicle until help arrived. He is now charged with three counts of assault, DWI, vehicular manslaughter and manslaughter, along with other criminal charges.

The scene was described as chaos. One person was impaled onto a fence. Another person had her ripped in half. The condition of the third injured party was not known. The man who died was 21 years old.

The driver may have a long list of criminal consequences related to this fatal accident. However, the family of the man who died and the injured victims may have legal options if they choose to pursue civil action against the driver. One option for the family of the man who lost is life is a wrongful death suit. If successful in a New York civil court, the family may garner monetary damages that will prove useful as they contend with any financial consequences of losing a loved one at the hands of a reckless or negligent individual.
