Impaired New York driver causes fatal accident involving bike

| Apr 12, 2016 | Wrongful Death

A young man on a motorized bike has lost his life due to the presumed negligence of another driver in the middle of the night. The 21-year-old man was driving a motorized bike down a New York street when he was hit head-on by a driver who veered into his lane. That driver has now been charged with numerous criminal charges related to the fatal accident, including driving while impaired.

The accident occurred around 3:45 a.m. The bike rider was headed east when the Acura driven by a 38-year-old man came along and entered his lane. He was hit head-on and rushed to a nearby hospital for treatment of injuries. He later died from those injuries.

The man who hit him did not have a driver’s license. He was also reported to be impaired and registered a .07 when a Breathalyzer test was conducted. While his car caught on fire from the collision, he escaped injury. He is facing manslaughter charges and other charges, also.

The family of the man who lost his life in this fatal accident may have legal recourse against that driver above and beyond what the criminal justice system can offer them as they deal with the gravity of the loss they have suffered. The family left behind may have cause to pursue a wrongful death claim in a New York civil court against this driver. If successful, the family could receive monetary damages which could prove beneficial as that family contends with medical bills, funeral costs and lost wages that impact those left behind as they grieve the loss of their loved one.
