On Behalf of | Jan 2, 2017 | Wrongful Death

A New York man’s alleged drunk driving recently resulted in a two-car collision in Colesville. The fatal accident left one man dead and his wife injured. The driver of the vehicle that police say caused the crash is now facing vehicular manslaughter and DWI charges.

New York State Police report that the 23-year-old Harpursville man implicated in the crash was traveling east on I-88 at around 10:53 on the evening of Wednesday, Dec. 28 when he ran into another car traveling in the same direction. The vehicle he hit was carrying the driver, a 64-year-old woman, and the passenger, her 67-year-old husband. When struck, their car was forced off the interstate and rolled over.

Investigators report the husband was ejected from the vehicle and declared dead at the scene. His wife, the driver, was transported to UHS Wilson Hospital, where she was treated for non-life threatening injuries. The driver who caused the accident reportedly suffered only minor injuries and refused treatment at the scene.

The accused man was arraigned in a local criminal court, where $2,500 cash or $5,000 bond was set; in lieu of posting it, he was taken to Broome County Jail. Considering the criminal charges the man is facing and his apparent fault in the fatal accident, the deceased man’s wife may opt to pursue wrongful death and personal injury claims in civil court. A successfully presented case could result in the award of monetary damages as provided by applicable laws. Any resident of New York who has lost a family member or loved one due to the negligence of another driver might benefit from contacting an attorney with experience in wrongful death claims to explore legal options.
