On Behalf of | Feb 10, 2015 | Wrongful Death

Depending on the circumstances, crossing the street can be treacherous endeavor. However, if everyone abides by the rules of the road, there may be minimal chance of an accident. One recent incident in New York proved to be a fatal accident after a pedestrian was struck by a vehicle. The woman behind the wheel now faces criminal charges related to the accident.

The hit and run pedestrian accident occurred around 8:30 p.m. on a Saturday. A woman was crossing a local roadway in Deer Park when she was hit. The driver was reported to be 57 years old. Apparently, the driver stopped momentarily at the scene but then left before the police were able to get to the scene.

There were witnesses at the scene who were able to relay a description of the vehicle to the police. Police say they spotted the vehicle and subsequently arrested the driver. She has been charged with leaving the scene of an accident resulting in death. At last report, the woman was awaiting arraignment.

A fatal accident such as this one can leave the family of the victim with unexpected or unmanageable financial bills with which to contend. The family of this New York victim may elect to pursue a wrongful death complaint against the driver even as she faces criminal charges related to the accident. If successful, a civil complaint may garner a monetary judgment that could help alleviate the financial losses suffered by the family of the victim as a result of this tragic accident.
